Here is the deal.

The Gym that I work for has been bought by another company about 20 months ago.

They pay my rate on the clients that came with the gym and I had to accept a 20% pay cut in order to keep my job.

Slowly and steadily they have not been giving me new clients, therefore my income slowly and steadily has been dropping.

I talked about this fact with my previous managers and they would give me a client here and another there.

My present manager when confronted about my situation has had 2 options so far:

1) he says that there isn't new business and therefore he can't do anything, them proceeds to tell me to go to the floor and sell PT.
Bullshit the gym from January until march got 300 new clients.

2) He started asking me about my clients' files (programs, periodization and shit) as far as I know he hasn't asked that to anyone else.
I am finishing the ****ing files this weekend as they are labour consuming and I don't get paid to do them.

Them the last drop: a past client decides to sign for more sessions, she asks about me and he send her to someone else saying that the change would be good for her.

Bullshit: the trainer that he assigned her, makes 1/2 of my hour fee and the charge the client the same value therefore he just want to increase his profit!


On top of that I am discriminated there as they never assign me straight guys, plus they ask the clients about the gender of the trainer that will take care of the client (do you prefer a male or female? - as far as I know that is the same that asking if someone prefers a black or asian trainer).

The ****er never asked about my qualifications, what type of client I want to train or anything like that.

Now I am deadly serious about taking legal action.

What do I need to do in order to make and win a case against this company?

Where do I go?

What type of proves do I need?

dude those three things right there are telling me he's trying to find a way to get you to quit...if there is legal action look into it..if not start looking for another job quick by the sounds of it you will not be working there much longer

what civil action are you going to take? what would you take them to court over? if you are going to take them to court you are going to need to be VERY specific about what you are taking them for. narrow down what actions you want to take and talk to a civil lawyer about it.

Well..you are the expert in that field.

Sometimes it is not worth trying to be somewhere where you are not wanted. It looks like they are trying to push you out. Instead of spending the time handing over all your routines and such. Spend that time finding a new gym. Once they have all your knowledge they will not need you and it will only get worse. They will not fire you but could lay you off citing lack of work.

Yes, but I am not ashamed as well therefore whenever anyone asks me if I have a gf I tell right away. "No, but I have a bf and we have been together for 8 years". Them if the client is willing to talk about his personal life (wife, girlfriend, kids, family) I guess that this is permission to talk about mine.

The interesting part of it is that I have never gotten any negative vibe from anyone. I train kids and their parents are all cool and stuff and the kids actually ask about my bf and stuff.

But I guess that the manager are not willing to risk to loose one possibly homophobic client as they never send straight guy to me.

As a heterosexual male, would I want a gay male trainer training my son? No I wouldn't, especially if he was talking about gay lifestyle and possibly influencing him.

I am contacting a lawyer that is specialized in human rights this coming week.

I am so pissed that I wanna give them just one blow and knock them down.

The reason for this thread is to have different perspectives....

Your situation appears to be a matter of discrimination based on sexual orientation. Section 15 of the Charter provides constitutional protection for sexual orientation, but the Charter is only enforcible against governments and direct government agents (i.e. police, etc). Thus you have two options.

The first is civil action under tort law. In this scenario you would have to demonstrate some type of quantifiable economic; emotional; or personal (primarily reputation) damage/harm. This is not very easy too do unless you have been documenting the discriminatory behaviours and/or have someone to corroborate what has transpired. The standard of proof required in tort proceedings is 'on a balance of probabilities' or in other words 'is it more likely than not that discrimination occurred'. Even though the standard of proof is not that onerous in tort actions, it will undoubtedly be very expensive to proceed with litigation. However, many jurisdictions now have compulsory mediation before a trial to attempt to bring the parties to a resolution without litigation.

The second is to lodge a formal complaint with your Provincial Human Rights Tribunal. Sexual orientation is provided protection by all provincial and territorial legislation. This is certainly the least expensive route.
