"A Friend Of Mine" recently recieved a pardon for an assault that took place 8 years ago, now while his CPIC record is clear of any criminal record it still shows the fireamrs prohibition that was levied at conviction. Now "My Friend" has never attemptted to enter the US because he was informed that if he waited to enter until after his pardon there would be nothing for US customs to find and subsequently download into the FBI database. Now the concern is, with the firearms prohibition in place, will US customs be able to see it? Thus knowing that some criminal offence has taken place in the past. The pardon lawyer forwarded an email from an RCMP forensics identification person where he states that he does not believe us customs has access to this information but i was hoping maybe someone in here has any information pertaining?

If a firearms prohibition is in place, yes they could see it, up to discretion of U.S. customs whether to deny entry or investigate. Get an immigration lawyer to take a look at your "friends" case

trust me on this.... Even if your buddy has a pardon it doesn't mean that the USA doesn't have a record of it!
Tell your buddy to be honest with the us customs.

Exactly, i have the same imaginary problem and even though i get pardened here in Canada the U.S. will still have the charge on file. You now have to go through the same shit with the U.S. and you don't get a parden, it's called something else, i forget..

Shit there is a paper you have to get from the Pardon parole board to fill in to see if the USA will let you in.Shit with drug charges the usa won't ever let you step on there Soil.

Thats the word i was looking for!! I think with a drug conviction a guy might as well forget about ever going south..

This is in direct contridiction to what i have heard from a friend of mine who has some connections in US customs. He has told me that as long as i never attempted to cross the border while my criminal record apeared on CPIC that if i travelled now they would not see it. I will have to look into it further because as bad as drug charges seem to be on getting across the border i can't imagine assault with intent would be much better.

A few months ago my girlfriend and I went to go to the states....... she was busted with a joint of hash....... 18 years ago in alberta.
Needless to say they refused her because of that....... they told her to get a waiver.

True..if your charged in Canada it DOESN"T show up on U.S customs computer unless your stupid enough to cross the border while you were on probation or when you haven't gotten a pardon yet. you cross when you haven't gotten a pardon then it's on there system and it;s there for good. The U.S doesnt have same laws as we do.

so you get charged ..wait your time and get your pardon....double check by getting a security check with the Police station....if it's empty your good to go to the states.

as for the gun thing...maybe call the R.C.M.P and see what they say!

Yes...don't cross over until after is off on this end and you wont screw yourself in the future...as once it's on there system..you wont be able to get it off even though you have a pardon here...hence they still can deny you entry or give you hard time each time. Pay your dues and stick to Canada holidays + it's safer :)


Really?? I haven't tried to cross since the conviction so i'm not in their system yet. That is good to know!
