Competition Bureau reaches settlement with Goodlife Fitness Clubs in advertising case
OTTAWA, February 9, 2005 - Concerns over the marketing practices of GoodLife Fitness Clubs Inc. have been resolved by way of a consent agreement filed today with the Competition Tribunal. Acting on complaints received from consumers, the Competition Bureau commenced an investigation of the company, which owns and operates 90 fitness clubs in Alberta, Manitoba, Ontario, Quebec, New Brunswick and Nova Scotia.

During the course of its investigation, the Bureau determined that a number of representations made by GoodLife in newspapers, on billboards and on storefront signs might raise issues under the Competition Act. In particular, the Bureau was of the view that GoodLife had failed to disclose additional mandatory fees in its advertising of membership offers. As a result, the actual price of memberships was greater than advertisements had led consumers to believe. It is a violation of the deceptive marketing practices provisions of the Competition Act to make representations that are false or misleading in a material respect.

Once contacted by the Bureau, GoodLife took immediate steps to correct its advertising practices in order to conform with the law. This cooperation permits an outcome which satisfies the Competition Bureau's concerns without costly litigation.

"The Bureau is committed to ensuring that consumers are not deceived by misleading advertising,"said Raymond Pierce, Deputy Commissioner, Competition Bureau. "Truth in advertising is fundamental to a marketplace that benefits consumers through fair and vigorous competition."

Under the terms of the consent agreement, which will remain in effect for 10 years, GoodLife has agreed to:

•publish a corrective notice in certain newspapers throughout Ontario and Quebec and on its Web site;
•pay an administrative monetary penalty of $75,000;
•administer a new corporate compliance policy to cover their marketing practices; and
•not make false or misleading representations in future promotional material.
The Competition Bureau is an independent law enforcement agency. We contribute to the prosperity of Canadians by protecting and promoting competitive markets and enabling informed consumer choice.

Premier Fitness Undisclosed Fees Investigation Successfully Concluded
Competition Bureau Reaches Settlement with Fitness Club Chain in Ontario

OTTAWA, November 27, 2007 — The Competition Bureau announced that it has reached a consent agreement with Premier Fitness Clubs, resolving the Bureau’s concerns over some of the company’s advertising practices from 1999 to 2004. The agreement was filed today with the Competition Tribunal.

During the course of its investigation, the Bureau determined that Premier Fitness Clubs did not adequately disclose additional fees that consumers would be obligated to pay in some of its advertising of membership offers on the radio, billboards, storefront signs, and in newspapers and flyers. Consumers who were induced by free trial offers ultimately had to pay a mandatory “fitness assessment” and/or had to sign up for a one-year contract in order to receive the “free” 30-90 day trial offer.

As a result, the actual price of memberships was greater than what the advertisements led consumers to believe. This contravened the false or misleading representations provision of the Competition Act. Premier Fitness Clubs owns and operates 35 clubs in Ontario.

“The Bureau is committed to ensuring that consumers are not enticed to make purchases based on misleading information,” said Andrea Rosen, Acting Deputy Commissioner of Competition. “Truth in advertising is fundamental so that Canadians do not sign contracts or make purchases only to find that additional costs have not been disclosed.”

Following the Bureau’s investigation, Premier Fitness Clubs has voluntarily taken steps to correct its advertising practices in order to conform with the law. This cooperation, along with the consent agreement, have resolved the Bureau’s concerns without having to proceed with costly litigation.

Under the terms of the 10-year consent agreement, Premier Fitness Clubs is required to:

•pay an administrative monetary penalty of $200,000.00;
•publish a corrective notice in three Ontario daily newspapers (the Toronto Sun, the Toronto Star, and the Ottawa Citizen);
•display a corrective notice in its clubs and on its Web site;
•implement a new corporate compliance policy to cover its marketing practices; and
•not make false or misleading representations in future promotional materials.
The Competition Bureau is an independent law enforcement agency. We contribute to the prosperity of Canadians by protecting and promoting competitive markets and enabling informed consumer choice.

If you ain't cheatin' you ain't trying :)

I'm a GL member but only due to convenience of facilities. In Ottawa I got 14 or so locations I can choose from and when I travel back home, on business, whatever I have access so that I can train without having to pay day-rates at other facilities as I normally would have to.

I was for a long-stretch of time paying over $100/month to other clubs due to my travels of visiting friends or family + business travel.

Thank goodness for the YMCA. While I'd prefer a dungeon, the Y is affordable, clean, and convenient.

While it could have better and more free weights it's at least as good as the chains and better in every other respect.

I must admit that when I was a member at GL, I NEVER had an issue. I paid about $500 for the 1st year, and then some ridiculously low price every 2 weeks - $9 or somethin.

Extreme Fitness on the other hand...they tried to hose me a couple of years after I left.

I did the same. Paid $500 upfront, then next to nothing biweekly. I think they used to count on people quitting a few months after putting the downpayment. I'm still at GL 9 years later. The only problem is I'm committed - I will never get a rate like this anywhere else.

Oh, and the ability to go to any GL location helps when travelling for work.

Ya - I regret leaving, but I changed jobs, and the GL I worked out at was close to my old job. In Whitby, the only GL is a women's and kids one. :mad:
